A by-election to elect ONE Councillor will be held on Saturday, 4 June 2011
Who needs to vote?
Please see below for eligibility conditions. A list of properties by street and the ward they belong to is available here. Eligible electors on the residential roll must vote at a contested election unless exempt from voting under the Local Government Act 1993. Electors on the non-residential roll or the roll of occupiers and ratepaying lessees may vote, but are not required to vote.
Voting on election day
Voting will take place on Saturday, 4 June 2011 between the hours of 8.00am and 6.00pm. If you are enrolled in Waverley Council – Hunter Ward local government area you must vote at one of the polling places listed below. Voting by post
Postal vote applications are available from www.elections.nsw.gov.au, the Returning Officer, the Council office or by calling 1300 135 736.
Completed application forms must be received by the Returning Officer, PO Box 2495 Bondi Junction NSW 1355 , fax: (02) 9290 5291, not later than 5.00pm Monday, 30 May 2011.
Voting is compulsory
Voting is compulsory for all electors. The penalty for not voting is $55.

Eligibility to vote in Hunter Ward by-election
To be eligible to vote in the by-election you need to be a person who is entitled to vote at an election of members of the Legislative Assembly or an election of the House of Representatives and resident in Hunter Ward; or a person who is entitled to vote at an election of members of the Legislative Assembly or an election of the House of Representatives and entitled to claim enrolment for this by-election as:
(i) A non-resident owner of rateable land in Hunter Ward; or
(ii) An occupier of rateable land in Hunter Ward who has a legally enforceable right to continuous occupation of rateable land (jointly or severally, but not as an owner or rate paying lessee) for not less than three years from the date on which the claim for enrolment is made; or
(iii) A rate paying lessee of rateable land who is jointly or severally liable, under a lease in writing or other document of title relating to the land, to pay to any person the whole or any part of any rates that may, during the 3 years from the date on which the claim for enrolment is made, be made or levied in respect of the land.
Where there is more than one occupier or rate paying lessee of the same parcel of rateable land, only one of them is entitled to be enrolled as an elector for the by-election. (Parcel of land, in relation to rateable land, means a portion or parcel of land separately valued under the Valuation of Land Act).
A non-resident owner who is the sole owner of rateable land is entitled to claim enrolment for the by-election. A person who is a non-resident owner may be nominated (in writing) for enrolment as an elector for the by-election in any of the following ways:
a) If the person is a joint or several owner of rateable land he or she may be nominated by the only other owner of the land or by a majority of all the owners of the land;
b) The person may be nominated by a corporation which is the owner, or by trustees who are the owners of rateable land;
c) If the person is a lessee of the land from the Crown and the land is rateable Crown land.
In all the above cases the rateable land must be in Waverley Council – Hunter Ward.
Claims for enrolment for eligible non-resident owners, rate paying lessees or occupiers closed on Wednesday 27 April 2011.
