Minutes of the Waverley Council Inspection Meeting held on Saturday, 3 May 2008 Council Meetings Minutes Index
PRESENT
Councillor Strewe (Mayor) (Chair) Councillors Betts, Clayton, Copeland, Kay, Main, Ridyard, Sloan and Wakefield.
At the commencement of proceedings at 12.45pm, those present were as listed above.
I-0805.A APOLOGIES
Apologies were received and accepted from Crs Kanak, Moscatt and Newhouse.
I-0805.DI DECLARATIONS OF INTEREST
The Chair called for Declarations of Interest and the following was received:
1. All Councillors declared a non-pecuniary interest in item I-0805.2.3 – Scrolling advertising signs on existing bus shelters – 22 locations within Waverley (DA 446/2007). The Chair informed the meeting that Council owns the bus shelters.
I-0805.1 GENERAL BUSINESS
There were no items of General Business.
I-0805.2 INSPECTIONS
I-0805.2.1 26 View Street, Queens Park – Alterations & additions to a semi-detached dwelling including a garage (DA197/2007)
This matter was last considered by Council at its Inspection Meeting on 5 April 2008. At that meeting Council deferred the matter to this meeting at the request of the applicant.
Report dated 8 March 2008 from the Development and Building Unit.
MOTION (Wakefield / Main)
That the application be refused in accordance with the reasons contained in this report.
FORESHADOWED MOTION (Betts / Sloan)
That the application be granted deferred commencement consent subject to standard conditions applying and the applicant satisfying Council as to the following matter:
1. The level above the garage be set back to align with the existing front gablet.
THE MOTION WAS PUT AND DECLARED LOST.
THE FORESHADOWED MOTION NOW BECAME THE SUBSTANTIVE MOTION AND WAS PUT AND DECLARED CARRIED.
DECISION: That the Substantive (Foreshadowed) Motion be adopted.
I-0805.2.2 93-99 Bronte Road, Bondi Junction – Mixed Development with Multi-Unit Housing (DA201/2007)
This matter was last considered by the Development Control Committee at its meeting on 22 April 2008. At that meeting the Committee decided to defer the matter to this meeting.
Report dated 17 March 2008 from the Development and Building Unit.
MOTION (WITHDRAWN) (Betts / Sloan)
That the application be determined without a site inspection.
During Council’s consideration of this motion Cr Sloan was ordered by the Chair to leave the chamber for an act of disorder. Cr Sloan left the chamber for the remainder of this part of the meeting.
MOTION / DECISION (Main / Strewe)
That Council inspect the site before determining the application.
UPON RECONVENING IN THE CHAMBER AFTER THE SITE INSPECTION THE FOLLOWING MOTION WAS MOVED, SECONDED AND DECLARED CARRIED:
MOTION / DECISION (Main / Clayton)
That the application be deferred to allow the applicant to submit amended plans showing the following:
1. The through side link be widened to 3.5m and lighting and a gate at the rear that can be closed be installed. Consideration is to be given to the installation of access ramping where possible.
2. A 50% open fence with sliding gates across the driveway is to be installed along the whole of the rear property boundary, including across the substation, to provide the site with some security.
3. The finish on the through side link is to be nonslip.
4. Consideration be given to deleting the two units on the top floor.
5. Consideration be given to reconfiguring the units without cross ventilation to provide them with cross ventilation.
6. Fisheye mirrors be installed on the property boundary at the driveway opening.
Cr Sloan absented herself from the chamber for the debate and vote on this item when Council reconvened after the site inspection.
I-0805.2.3 Scrolling advertising signs on existing bus shelters – 22 locations within Waverley (DA 446/2007)
This matter was last considered by the Development Control Committee at its meeting on 22 April 2008. At that meeting the Committee decided to defer the matter to this meeting.
Report dated 22 February 2008 from the Development and Building Unit.
MOTION / UNANIMOUS DECISION (Betts / Strewe)
That the application be refused for the following reason:
1. The installation of scrolling advertising at these locations will have an adverse impact on motorist and pedestrian safety.
FORESHADOWED MOTION (Wakefield)
That the application be deferred to the next Council meeting to allow relevant staff and other Councillors to be present.
THE MOTION WAS PUT AND DECLARED CARRIED UNANIMOUSLY.
All Councillors declared a non-pecuniary interest in this item. The Chair informed the meeting that Council owns the bus shelters.
Council decided not to inspect the 22 locations.
The CEO of JCDecaux addressed the meeting.
I-0805.RM SUBMISSION OF RESCISSION MOTIONS
Note from the General Manager: Rescission motions received before the close of a meeting will stay action to implement Council's decision until the rescission motion has been determined. This is in line with section 372 of the Local Government Act and Council's Code of Meeting Practice.
Rescission motions must be submitted to the General Manager, or in the absence of the General Manager a member of Council's Governance Unit, and announced before the close of the meeting. The date and time of receipt will be noted on all rescission motions.
Rescission motions received after the close of a meeting will not stay action on implementing Council's decision.
Rescission motions will generally be dealt with at the next Council meeting.
The Chair called for the submission of any rescission motions and none were received.
