Minutes of the Waverley Council Inspection Meeting held on Saturday, 5 April 2008 Council Meetings Minutes Index
PRESENT
Councillor Strewe (Mayor) (Chair) Councillors Betts, Clayton, Copeland, Kanak, Kay, Main, Newhouse and Wakefield.
At the commencement of proceedings at 12.35pm, those present were as listed above with the exception of Cr Newhouse, who arrived at 12.40pm, and Cr Wakefield who arrived during the first inspection item which was 34 Dellview Street, Tamarama.
At 12.38pm, the meeting was adjourned for the purpose of conducting inspections.
At 3.15pm, Council reconvened in the Council chamber.
I-0804.A APOLOGIES
Apologies were received and accepted from Crs Moscatt, Ridyard and Sloan.
I-0804.DI DECLARATIONS OF INTEREST
The Chair called for Declarations of Interest and the following was received:
1. All Councillors declared a non-pecuniary interest in Item I-0804.2.3 – Bondi Pavilion, Queen Elizabeth Drive – Surfish Café – Outdoor seating and installation of umbrellas within the forecourt of the Heritage Item (DA 120/2007) as the Pavilion is Council controlled property.
I-0804.1 GENERAL BUSINESS

I-0804.2 INSPECTIONS
I-0804.2.1 26 View Street, Queens Park – Alterations & additions to a semi-detached dwelling including a garage (DA197/2007)

MOTION / DECISION (Betts / Main)
That the application be deferred to the next Council Inspection Meeting to be held on Saturday, 3 May 2008, at the request of the applicant.
I-0804.2.2 34 Dellview Street, Tamarama – Demolition of existing three storey flat building containing six units and construction of three four-storey attached townhouses with basement level parking (DA 317/2007)

MOTION / DECISION (Strewe / Main)
That the application be refused in accordance with the following reasons:
1. The proposal is contrary to the State Government objective of increasing housing stock.
2. It is likely to have a detrimental social impact due to loss of affordable housing. Clause 18 of the Waverley LEP recognises the social need for the preservation of affordable housing stock. Four of the six units in the existing building are classified as low cost rental units.
3. The proposal is detrimental to the existing streetscape as the current building is one of a pair of elegant Georgian style blocks.
4. Notwithstanding the applicant’s right under the EP&A Act, the technical non-compliance with 2(b) zoning of the area is substantial as per the compliance table contained in the report. The FSR of the existing building is 1.588:1 and of the proposed building is 1.84:1. There is a substantial non-compliance with the DCP and an increase on the existing non-compliant building. In addition there is a basement level carpark and lift which add materially to the bulk and scale of the dwelling which has not been included in the FSR assessment. The cumulative effect of the significant non-compliance with the objectives of the residential 2(b) zone makes for a bulky intrusive development.
5. The proposal has inadequate setbacks against the requirements of the DCP. The proposal seeks to further reduce existing inadequate setbacks so is likely to increase the impact on neighbouring properties. The application therefore fails to comply with the objectives of the DCP regarding setbacks.
6. There is inadequate provision for deep soil planting and unbuilt upon area. The DCP applicable to developments in a 2(b) residential zone identifies 30% deep soil planting. The existing development provides 20.7%. The application seeks to reduce this further to 18.8%, and is a reduction of 10% on the existing inadequate unbuilt area. The applicant fails to address the objectives of the DCP.
I-0804.2.3 Bondi Pavilion, Queen Elizabeth Drive – Surfish Café – Outdoor seating and installation of umbrellas within the forecourt of the Heritage Item (DA 120/2007)

MOTION / DECISION (Clayton / Betts)
That the application be approved in accordance with the conditions contained in this report subject to the following additional conditions:
1. The designated outdoor seating area be clearly marked.
2. Metal cutlery and crockery is to be used for table service, and non-plastic, biodegradable material is to be used for takeaway service.
3. A clean up diary is to be kept.
4. The furniture be upgraded to DCP standard and match the surrounding furniture to the satisfaction of the Director, Planning & Environmental Services.
All Councillors declared a non-pecuniary interest in this item as the Pavilion is Council controlled property.
I-0804.2.4 164-166 Hastings Parade, Bondi – Demolition of existing semi detached dwellings and construct a new dwelling with garages (DA 285/06)

MOTION (Newhouse / Strewe)
That the application be approved in accordance with the conditions contained in this report subject to the following additional conditions:
1. The plans be amended to show the modified roofline in accordance with the drawing tabled at the on-site inspection by the residents of the neighbouring property to the south, to the satisfaction of the Director, Planning & Environmental Services.
2. The rear building line on the first floor be reduced by 300mm.
AMENDMENT (Wakefield / Main)
That the Motion be adopted subject to the rear building line being brought back inline with 162 Hastings Parade and the prevailing building line.
THE AMENDMENT WAS PUT AND DECLARED LOST ON A SHOW OF HANDS 4/5.
THE MOTION WAS THEN PUT AND DECLARED CARRIED.
DECISION: That the Motion be adopted.
I-0804.2.5 106 Glenayr Avenue, Bondi Beach – Provide outdoor seating (FPS 44/2007)
Report dated 12 March 2008 from the Development and Building Unit.
MOTION / DECISION (Newhouse)
That the application be approved in accordance with the conditions contained in this report subject to the following amendments and additional conditions:
1. The hours of operation of the outdoor seating be limited to between 8am and 8pm.
2. The consent will not commence until a fully operational toilet with hand basin and hand towels be in place and available to the applicant’s customers.
3. The term of the Roads Act lease is to be drafted so that it terminates if the premises ceases to be used as a commercial bakery. That is, the premises ceases to provide a range of breads and/or cakes to the public who are not café customers.
4. There be no outdoor seating on Warners Avenue.
I-0804.2.6 86 Roscoe Street, Bondi Beach – Hardstand car space within the front yard of the existing semi detached dwelling (DA 668/07)
Report dated 20 February 2008 from the Development and Building Unit.
MOTION / DECISION (Newhouse / Clayton)
That the application be deferred to allow the Divisional Manager, Technical Services to prepare a report on the possibility of Council offering a non-transferable Roads Act lease to the applicant for a peppercorn rent on the following basis:
1. Use of a temporary gutter crossing.
2. There be minimal change to the front yard and Council owned footpath.
3. “No stopping” signs be installed on either side of the footpath crossing.
4. The lease be reviewed every 5 years.
5. Council grant permission to the applicant to stand a vehicle in the front yard for the period of the lease.
I-0804.RM SUBMISSION OF RESCISSION MOTIONS
Note from the General Manager: Rescission motions received before the close of a meeting will stay action to implement Council's decision until the rescission motion has been determined. This is in line with section 372 of the Local Government Act and Council's Code of Meeting Practice.
Rescission motions must be submitted to the General Manager, or in the absence of the General Manager a member of Council's Governance Unit, and announced before the close of the meeting. The date and time of receipt will be noted on all rescission motions.
Rescission motions received after the close of a meeting will not stay action on implementing Council's decision.
Rescission motions will generally be dealt with at the next Council meeting.
The Chair called for the submission of any rescission motions and none were received.
