Access to council information

On the 1 July 2010 the Government Information (Public Access) Act 2009 (the GIPA Act) came into effect, replacing the former Freedom of Information Act 1989.

The new Act:

  • Creates new rights to information to meet community expectation of open and transparent government
  • Encourages proactive release of government information

Information Guide

Waverley Council’s Information Guide outlines Council’s structure, functions, the information it holds and how the community can access the information and also participate in Council’s activities.

Waverley Council is committed to open government and provides access to its information in the following ways:

  1. Mandatory Proactive Release (Open Access)
    This information is available on Council's website and is available free of charge and includes Council's:
     
    Plans, policies and reports
    Register of Government Contracts
    Meeting Agendas and MinutesMedia ReleasesAnnual Reports
    Development Application Progress Enquiries

    If the information you are seeking relates to Development Applications, Construction Certificates, Building Applications, Footpath Seating Applications and subdivision Applications, please use the Application for search and viewing of application files.

  2. Proactive Release
    Waverley Council is constantly reviewing its information and progressively making as much information of public interest, as is possible, publicly available free of charge or at minimal cost.

  3. Informal Release
    You can also make an informal request for information by contacting us and asking for the information. Subject to any reasonable conditions, this information may be released informally.

    It is important that you provide an accurate description of the information you are seeking to access. Do not request 'all documents', requests must be for specific information or groups of documents.

    An informal request for information can be submitted by emailing us or by fax 9387 1820.

  4. Formal Release
    The release of all other information can be made by way of a Government Information (Public Access) Act 2009 Access Application (GIPA Application). Fees and charges and time frames are applicable for such applications and third party consultation may be required.

    The fee for a formal access application is $30.00 application fee and $30.00 per hour thereafter to process the application.

    Formal access applications (GIPA Applications) are required to be completed in 20 working days from the date of receipt. If consultation with a third party is required, a further 15 days extension is allowed. You will receive a formal determination letter with the requested documents or reasons why a document has been withheld.

Restrictions to the release of documentation

Access to information will be granted by Waverley Council unless there is an overriding public interest against disclosure of the information in accordance with the provisions of the Government Information (Public Access) Act 2009 (GIPA Act). More information on how government agencies apply the public interest test when determining whether or not to release information, can be obtained from the Information and Privacy Commissioner.

Your Review Rights

If access to information has been refused, or you are not satisfied with the information received, an appeal against the decision can be lodged by completing a Request for Internal Review Application. A $40.00 fee is payable for an Internal Review.

Following the Internal Review decision, if you are still not satisfied, you may appeal to either the Information and Privacy Commissioner or the Administrative Decisions Tribunal.

Disclosure Log

A Disclosure Log is a record of information a Council has released under the Government Information (Public Access) Act 2009 and is part of the open access information that Council is required to make available. The Disclosure Log lists the information released, the date of the decision and how to access this information.
