Addressing the Panel

If you wish to address the Panel regarding an item on the agenda, you must first register with the Panel Co-ordinator by 12 noon on the day prior to the meeting. To register, please email WDAP@waverley.nsw.gov.au or phone 9083 8273. You must already have lodged a written submission on the Development Application (DA) you wish to address or provided a written summary outlining the issues you wish to raise to the Panel Co-ordinator at least 24 hours before the meeting.

Unless the Panel otherwise permits, no resident, objector, applicant or supporter who addresses the Panel at any meeting of the Panel may speak for more than 3 minutes in respect of any one matter before any particular meeting.

If you address the Panel, your name will be included in the minutes of the meeting unless you request that it not be included.

About the Waverley Development Assessment Panel (WDAP)

What is the WDAP?

The Waverley Development Assessment Panel determines significant DAs in the Waverley LGA. This includes DAs where there are numerous objections, a conflict of interest or the development has a construction cost of $3 million or more.

At its meeting of 18 June 2013, Council formally adopted the new Panel and dissolved the former Development Control Committee (DCC) and the Independent Hearing & Assessment Panel (IHAP).

The Panel is made up of a pool of planning experts, independent of Council, who meet monthly. The Panel replaces the former DCC and the IHAP, which will help streamline the planning process. It also means that Councillors will no longer be involved in the decision-making process for determining those DAs, allowing them more time to focus on strategic planning issues, such as the planning controls that underpin DA decisions.

Panel members

The Panel members are independent of Council. Each Panel will consist of a specialist from the disciplines of Architecture, Urban Design, Town Planning and Planning Law as well as community representatives and specialists in Aboriginal Archaeology and Heritage, Disability and Access, Coastal Risk and Water Management and Environmental Flora/Fauna Diversity.

The Panel members will be introduced at the meeting. The quorum for a meeting of the Panel is three members. Council staff will attend to provide technical advice on Council’s controls or answer questions if required.

The report on the DA is prepared by Council’s Development & Building Unit (DBU) for consideration and includes a full assessment of the proposal, the objections made and a recommendation.

When and where are meetings held?

The Panel meets on the fourth Wednesday of the month at 12 noon. Meetings are held at Council Chambers on Level 3, on the corner of Paul Street and Bondi Road. Prior to the meeting, the Panel members will undertake an inspection of the sites to be considered at the meeting.

Types of development applications referred to the Panel

The following matters not otherwise delegatedto the General Manager will be referred to the Panel for determination:

  1. Development Applications for Class 1 and 10 buildings that receive 4 or more unresolved objections.  
  2. Development applications for Class 2-9 buildings that

    a) have a value of greater than $3m, or
    b) have received more than 6 unresolved objections,

  3. Applications for review of a decision or modification of a condition made by the Development and Building Unit (DBU) where the DBU does not support the application.
  4. Applications for review of decisions or modification of a condition made by the Panel or Development Control Committee, where:

    a) In the case of Section 82a reviews of refusals, all applications determined by the Panel or DevelopmentControl Committee; and
    b) In the case ofSection 96 modifications of conditions of a determination made by the Panel orDevelopment Control Committee, where the condition required a design or otherchange relating to a development standard or unresolved objection.

  5. Development applications where the owner, applicant or objector is a staff member orCouncillor of Waverley Council and any unresolved objections have been received.
  6. Development Applications that, in the opinion of the General Manager or Director WaverleyFutures or delegate should be determined by the Panel for public interest reasons.

    *Unresolved Objections - For the purposes of referralto the WDAP, an unresolved objection means: An objection that directly relatesto an impact caused by, or as a result of, non compliance with a developmentstandard and is considered by the Director of Waverley Futures or delegate tohave planning merit, relevance, substance, reasonableness and validity, andwhich has not been addressed by the imposition of conditions of consent.

How does the WDAP work?

The Chairperson opens the meeting and introduces the Panel members. The order of business is set out in the agenda. Copies of the agenda will be available at the meeting.

As each item is referred to, the objectors are invited to speak for three minutes. The applicant will then be invited to respond. The Panel members may ask questions of the addressees.

Speakers should bear in mind that the Panel members have had the report for a few days and it is not necessary to repeat information that has been provided in the report.

Speakers may table photographs and supplementary material at the meeting if they wish.

Once all the registered speakers have addressed the Panel on the item, the Panel will move to the next item on the agenda and continue to receive speakers until all items on the agenda have been addressed. The meeting will then officially close and the panel will move to a closed session to deliberate and determine each item. Members of the public will not be able to participate in this part of the meeting.

Minutes of the meeting will generally be available for viewing from Council’s website the following day.
